1. Acceptance of Terms

By accessing and using RaceMission, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use of Service

RaceMission is a web-based software-as-a-service platform. You are granted a limited, non-exclusive, non-transferable right to access and use the Service through your web browser or authorized API integrations during your subscription or active account period. No software is downloaded or transferred to you. Under this license you may not:

• Attempt to copy, reproduce, or replicate the Service or any portion of it
• Use the Service for any unlawful or unauthorized purpose
• Attempt to decompile, reverse engineer, or extract source code from the Service
• Remove any copyright, trademark, or other proprietary notices
• Resell, sublicense, or otherwise make the Service available to third parties without our permission
• Use automated tools, scrapers, or bots to access or extract data from the Service without permission

3. Timing Services & Connectivity Disclaimer

RaceMission provides race timing tools as a component of the platform. While we strive for reliability, you acknowledge and agree that:

• Internet connectivity and network availability at your event venue are entirely outside RaceMission's control.
• The event organizer is solely responsible for ensuring adequate connectivity at the venue, including sourcing backup or redundant network solutions where reliability is critical.
• RaceMission makes no guarantee that timing features will function in environments with limited, intermittent, or absent internet connectivity.
• RaceMission shall not be liable for any failure, inaccuracy, or loss of timing data resulting from connectivity issues, hardware failures, or other conditions outside of our direct control.
• Event organizers are strongly encouraged to maintain a manual backup timing plan for all events. Failure to do so is at the organizer's sole risk.

4. Disclaimer

The Service is provided on an 'as is' basis. RaceMission makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

5. Limitations

In no event shall RaceMission or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on RaceMission, even if RaceMission or an authorized representative has been notified orally or in writing of the possibility of such damage.

6. Accuracy of Materials

The materials appearing on RaceMission's website could include technical, typographical, or photographic errors. RaceMission does not warrant that any of the materials on the website are accurate, complete, or current. RaceMission may make changes to the materials contained on its website at any time without notice.

7. Links

RaceMission has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by RaceMission of the site. Use of any such linked website is at the user's own risk.

8. Modifications

RaceMission may revise these terms of service for the website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

10. User Accounts

You are responsible for maintaining the confidentiality of your account information and password. You agree to:

• Provide accurate and complete information when creating an account
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

11. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Harassing or causing distress or inconvenience to any person
• Obscene or abusive language
• Disrupting the normal flow of dialogue within our platform
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the service

12. Payments and Fees

By using RaceMission, you agree to pay applicable fees:

• Registration platform fee: 5% + $0.99 all-in per registration (includes payment processing)
• Timing services: Free (≤100 participants), $19/event pass, or $19/month ($149/year) subscription
• All fees are in USD and may be subject to applicable taxes

Refunds are subject to our refund policy. All charges are processed through Stripe.

13. Intellectual Property

The content, organization, graphics, design, and other matters related to the Site are protected under United States and international copyright and other laws. You may not reproduce, publish, transmit, or distribute any material from the Site without prior written permission.

14. Termination

RaceMission may terminate or suspend your account and access to the Services at any time, for any reason, without notice or liability.
